Repeals the Mississippi Health Care Certificate of Need Law of 1979 (Sections 41-7-171 through 41-7-209), eliminating the requirement for healthcare facilities to obtain state approval before building new facilities, expanding services, or purchasing major medical equipment

Amends approximately 25 sections of Mississippi Code to remove all references to certificate of need requirements for hospitals, home health agencies, ambulatory surgical facilities, birthing centers, nursing homes, and other healthcare facilities

Removes certificate of need requirements from the licensing process for critical access hospitals, allowing them to add beds and services without state approval beyond standard licensure

Eliminates the fee structure previously used to fund the certificate of need program, including application fees up to $50,000 based on proposed capital expenditure amounts

Effective date of July 1, 2021
