Adds disability, sexual orientation, and gender identity to the list of protected characteristics under Mississippi's hate crime enhancement statute (Section 99-19-301).

Expands hate crime penalties to apply when crimes are committed because of the actual or perceived disability, sexual orientation, or gender identity of the victim.

Requires juries in hate crime sentencing proceedings to find beyond a reasonable doubt that the defendant committed the offense because the victim was within a protected class, including the newly added characteristics.

Conforming amendments made to Section 99-19-305 to reflect the expanded list of protected characteristics in sentencing proceedings.

Effective date: July 1, 2021.
