Senate Bill 2307 Summary

• Removes provisions from Section 37-173-9 requiring school districts to make initial IDEA eligibility determinations for students with dyslexia before developing 504 Plans.

• Creates new Section 37-173-16 requiring school districts to first determine if students diagnosed with dyslexia meet IDEA eligibility criteria, then proceed to 504 Plan evaluation if IDEA ineligible.

• Establishes presumption that proficiency in spelling, reading, and writing are essential for appropriate educational progress in dyslexic students for purposes of 504 Plan development.

• Requires school districts to develop interventions and strategies including the 3-Tier Instructional Model and utilization of IDEA and Section 504 provisions to accommodate dyslexic students.

• Takes effect July 1, 2021.
