Allows individuals convicted of a first offense DUI to petition for expunction after 10 years (in addition to the existing 5-year option) if they completed their sentence, have no other DUI convictions or pending charges, provide justification to the court, and have not previously received a nonadjudication or expunction

The 10-year expunction pathway removes certain requirements from the 5-year option, including that the person must not have refused a blood or breath test and must have had a BAC below 0.16%

Commercial driver's license or commercial learning permit holders at the time of the offense remain ineligible for expunction under either timeline

Only one expunction is permitted per person, and the Department of Public Safety maintains a permanent confidential registry of all expunctions to determine future eligibility
