HB 1418 - Second Amendment Preservation Act

• Mississippi Legislature preempts all local firearms regulation, declaring any existing or future county, city, or municipal orders on firearms, components, ammunition, and supplies null and void.

• Federal acts ordering confiscation of firearms from law-abiding citizens are declared invalid in Mississippi; state courts and law enforcement must protect citizens' Second Amendment rights and cannot enforce such federal provisions.

• Any federal official or employee enforcing federal firearm confiscation acts is guilty of a misdemeanor; Mississippi citizens subjected to such enforcement have a private cause of action for damages and declaratory judgment.

• Political subdivisions may only regulate firearm discharge within their jurisdiction, open carry, and specific locations (public parks, athletic events, polling places, courtrooms, schools); counties and municipalities cannot prohibit firearms manufacturers from lawful business operations.

• Provisions do not apply to universities, colleges, community colleges, or junior colleges; act takes effect July 1, 2022.
