House Bill 380 Summary

• Expands health insurance coverage requirements to include diagnosis and treatment of developmental and physical disabilities alongside existing autism spectrum disorder coverage, effective January 1, 2023.

• Defines "developmental or physical disability" as a severe chronic disability (excluding mental illness and autism) manifesting before age 19, likely to continue indefinitely, causing substantial functional limitations in at least three major life activity areas.

• Limits applied behavior analysis coverage to $40,000 per year with maximum of 10 hours per week for licensed behavior analysts, and extends coverage eligibility to age 18 (previously age 8 for autism only).

• Requires insurers to review treatment plans every six months at the insurer's expense, prohibits coverage termination based on disability diagnosis, and maintains existing carve-outs for school-based services and certain limited benefit plans.

• Takes effect July 1, 2022.
