House Bill 746 - Mississippi Retail Marijuana Act

• Authorizes personal use of marijuana by persons 21 years of age and older, including possession of up to one ounce, home cultivation of up to six plants (three mature), and transfer of up to one ounce without payment to others 21+.

• Establishes comprehensive licensing system administered by the State Department of Health executive director with 10 different license types (retail stores, cultivation facilities, manufacturers, testing facilities, transporters, hospitality businesses, and accelerator programs for social equity licensees).

• Creates seed-to-sale tracking system, mandates testing for contaminants and potency, requires child-resistant packaging with warning labels, and prohibits open/public consumption except in licensed hospitality venues.

• Implements $5,000 application fee split equally between state and local jurisdiction; allows local governments to regulate or prohibit marijuana businesses through local ordinance.

• Establishes Marijuana Cash Fund to support regulatory operations; amends controlled substances statutes to exclude lawfully-produced marijuana and clarifies marijuana impairment applies to DUI laws and school incident reporting.
