Clarifies that out-of-state DUI convictions obtained in another state, territory, or federally recognized Native American tribe can be counted toward penalty enhancement for second, third, fourth, or subsequent DUI offenses in Mississippi.

Requires all expunctions for DUI violations, including those granted by intervention courts, to be recorded in a confidential registry maintained by the Department of Public Safety for tracking eligibility purposes.

Requires all nonadjudications and dismissals of DUI charges granted by intervention courts to be recorded in the confidential registry of nonadjudications established under DUI law.

Mandates that law enforcement submit certification that prior convictions, nonadjudications, pretrial diversions, and arrests have been searched before a defendant enters a guilty plea for a DUI offense.

Takes effect July 1, 2022.
