First offense simple possession of controlled substances (except small amounts of marijuana/synthetic cannabinoids) reduced to a misdemeanor punishable by up to 6 months imprisonment and/or $100 fine; second offense up to 1 year and/or $200 fine

Enhanced penalties for simple possession now apply only to third or subsequent offenses, rather than second offenses under prior law

Doubles the offense threshold for enhanced repeat offender penalties under Section 41-29-147, requiring a fourth or subsequent conviction (previously second) before sentences and fines can be doubled

Possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids remains punishable by fines of $100-$250 for first offense, with escalating penalties for repeat offenses within two years
