Permits commercial driver's license (CDL) holders to be eligible for nonadjudication of a first-offense DUI if they were not operating a commercial vehicle at the time of the offense.

Applies the same nonadjudication eligibility to expunction of first-offense DUI convictions for CDL holders who were operating non-commercial vehicles.

Requires CDL holders seeking nonadjudication to meet the same conditions as other first-time DUI offenders, including completion of alcohol safety education programs and potential ignition-interlock device installation.

Maintains that CDL holders operating commercial vehicles remain ineligible for nonadjudication of first-offense DUI.

Takes effect July 1, 2022.
