Changes texting while driving violations from a civil penalty to a misdemeanor criminal offense with fines up to $500

Imposes an additional fine up to $1,000 if a person violates the texting law while involved in a motor vehicle accident

Requires law enforcement to document wireless device use on accident reports when a driver is cited for texting while driving

Exempts law enforcement, emergency vehicle drivers, persons reporting dangerous behavior, persons in physical danger, and those sending messages while parked
