Redefines rape as penetration of the vagina or anus with any body part or object, or oral penetration by a sex organ, accomplished against the victim's will by force/threat/intimidation, without consent, or when the victim is physically/mentally helpless or incapacitated

Explicitly removes spousal exemption by specifying the crime applies "whether or not his or her spouse"

Establishes penalties for rape conviction: up to 30 years imprisonment for first offense, up to 40 years for subsequent offenses

Repeals Section 97-3-99, which previously provided a defense of marriage to sexual battery crimes

Updates gender-neutral language in related statutes, changing "female" and "injured female" to "complaining witness"
