MS HB1031

Establishes a lien for hospitals and health care providers on all claims and damages recovered by patients, including third-party liability settlements, auto insurance benefits, and wrongful death claims.

Requires the lien to be filed in the circuit court clerk's office of the county where the hospital is located, including a verified statement with patient information, admission/discharge dates, and amounts claimed.

Prohibits satisfaction of any judgment, award, settlement, or compromise without first notifying the health care provider and satisfying the hospital lien.

Amends Section 83-9-47 to grant health care providers a lien on gross proceeds of payments made directly to patients by third-party payors for medical services rendered.

Takes effect July 1, 2023.
