HB 1133 Summary

• Prohibits state and local officials from enforcing federal firearms laws, regulations, or executive orders that have not been formally adopted by Congress and signed by the President, if they relate to firearms, accessories, or ammunition owned or manufactured in Mississippi and remaining within state borders.

• Imposes civil penalties of up to $1,000 for first violations and criminal penalties (misdemeanor) of up to $5,000 fine or six months imprisonment for second violations by officials attempting to enforce such laws.

• Authorizes the Mississippi Attorney General to defend state residents charged by the federal government for violating non-congressionally adopted federal firearms laws.

• Amends existing firearm licensing statutes (Sections 45-9-101, 97-37-5, 97-37-7, 97-37-31, 97-37-103, and 97-37-105) to make them subject to the act's provisions and clarifies that the act does not apply to actions solely facilitating federal firearms transfers.

• Effective July 1, 2023.
