Plan sponsors of health benefit plans may provide consent on behalf of covered persons for electronic delivery of all plan-related communications under the Mississippi Insurance E-Commerce Model Act.

"Health benefit plan" is defined as any policy, contract, certificate or agreement providing, delivering, arranging for, or reimbursing healthcare services, including vision or dental benefits.

Plan sponsors must confirm that individuals routinely use electronic communications during their normal course of employment before consenting to electronic delivery on their behalf.

Insurers must provide covered persons an opportunity to opt out of electronic delivery and must document that all conditions of the Mississippi Insurance E-Commerce Model Act (Sections 83-5-857, 83-5-859, 83-5-861, 83-5-867, and 83-5-869) are satisfied.

The Commissioner of Insurance is authorized to adopt rules to implement the provisions of this act, effective July 1, 2023.
