MS HB1295

Amends Mississippi Code Section 91-27-29 to exempt real property transferred via transfer-on-death deed from claims of creditors of the deceased transferor or the transferor's estate, unless such claims attached to the property before death.

Provides that designated beneficiaries take title to transferred real property free and clear of estate creditors' claims.

Preserves the requirement that beneficiaries take property subject to existing conveyances, encumbrances, mortgages, liens, and other interests present at the transferor's death.

Brings forward Section 91-27-27 (relating to effects of transfer-on-death deeds at transferor's death) for possible amendment, including provisions on joint ownership, revocation rights, and concurrent interests.

Effective July 1, 2023.
