House Bill 1437 Summary

• Removes the age restriction for expunction of misdemeanor convictions in municipal court by deleting the requirement that a person be under 23 years old to qualify for expunction under Section 99-19-71.

• Allows any first offender convicted of a misdemeanor (excluding traffic violations) in municipal court to utilize expunction provisions regardless of age.

• Maintains existing requirements that individuals must demonstrate rehabilitation and good conduct for two years since last conviction before expunction can be granted.

• Takes effect July 1, 2023.
