Extends the lookback period for counting prior DUI offenses from 5 years to 10 years when determining whether a violation is a second, third, or subsequent offense for penalty enhancement purposes

Increases the maximum jail time for first-offense DUI from 48 hours to 90 days, with courts permitted to substitute victim impact panel attendance instead of jail time

Adds new aggravating factors that allow courts to double penalties: DUI causing bodily injury to another person, or DUI with a blood alcohol concentration of 0.20% or higher

Adds two new eligibility restrictions for nonadjudication (avoiding formal conviction): defendants cannot have a BAC of 0.20% or higher, and cannot have been involved in an accident causing bodily injury to another person

Extends the waiting period for expunction of a first DUI offense from 5 years to 10 years after successful completion of all sentence terms and conditions
