Removes the prohibition that prevented holders of commercial driver's licenses or commercial learning permits from receiving nonadjudication for first-offense DUI convictions under Section 63-11-30.

Eliminates restrictions on expunction of first-offense DUI convictions for commercial driver's license holders, allowing them to petition for record expungement five years after successful completion of all sentence requirements.

Makes nonadjudication and expunction eligibility consistent across all DUI offenders regardless of commercial license status, while maintaining other eligibility requirements such as successful program completion and prior offense history.

Takes effect July 1, 2023.
