Uninsured drivers (including uninsured permissive and nonpermissive drivers) waive their right to sue for economic or noneconomic losses in accidents where the at-fault driver has valid liability insurance under Mississippi's Motor Vehicle Safety-Responsibility Law

The waiver does not apply if the insured at-fault driver was under the influence of drugs or alcohol, or was convicted of manslaughter or assault arising from the accident

Drivers whose insurance lapsed due to nonpayment are exempt from this waiver unless their insurer provided termination notice at least 6 months before the accident

Passengers in uninsured vehicles are only subject to this recovery limitation if they knew or should have known the driver lacked insurance
