First offense possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids becomes a civil offense (not criminal) with a civil fine of $100-$250.

Second conviction within 2 years remains a misdemeanor with $250 fine, up to 60 days in county jail, and mandatory drug education program participation.

Third or subsequent conviction within 2 years is a misdemeanor with $250-$1,000 fine and up to 6 months in county jail.

First and second convictions result in private, nonpublic records maintained by Mississippi Bureau of Narcotics for 2 years, then automatically expunged; records do not constitute criminal records for private or administrative inquiry.

Act takes effect July 1, 2023.
