Amends Mississippi property law to exclude conveyances of primary residences to married couples from the default rule that creates estates in common

Creates a rebuttable presumption that property conveyed to a married couple is their primary residence and is held as joint tenancy with right of survivorship

Allows the presumption to be overridden only if the deed contains specific provisions stating otherwise

Maintains existing law that joint tenancy or entirety between spouses can be terminated by deed from one spouse to the other without the grantee spouse's joinder

Effective date of July 1, 2023
