House Bill 812 Summary

• Creates the "Racial Profiling Prevention Act" prohibiting law enforcement officers from engaging in racial profiling based on race, color, ethnicity, national origin, age, gender, religion, sexual orientation, gender identity, or immigration status.

• Requires all law enforcement agencies to adopt written policies prohibiting stops, detentions, or searches motivated solely by these protected characteristics.

• Mandates law enforcement agencies collect and retain data on traffic stops including number of stops, demographic characteristics of stopped individuals, violation type, and stop outcomes; agencies must submit annual reports to the Attorney General by January 1.

• Requires law enforcement agencies to promptly forward complaints alleging racial profiling to local district attorneys along with written notification of the complaint review and disposition.

• Directs the Attorney General to develop complaint forms and traffic stop documentation forms by October 1, 2023, and establish penalties including state fund withholding for non-compliant agencies; effective July 1, 2023.
