Amends Mississippi Code Section 97-3-65 to create an exception to statutory rape charges when both persons are dating partners and both are enrolled in secondary school.

The exception applies specifically to cases where one person is 17 or older, the other is at least 14 but under 16, and at least 36 months younger, provided both attend secondary school.

Also clarifies that the dating partner exception does not apply to sexual assault charges involving administering substances to incapacitate victims, even if the perpetrator and victim are dating secondary school students.

Maintains all existing statutory rape penalties and sentencing provisions, including imprisonment up to 30-40 years for offenders 21 and older.

Takes effect July 1, 2023.
