HB 859 Summary

• Exempts public special purpose schools from State Auditor inventory audit requirements for wireless communication devices, equipment, and technology issued to students for distance learning and 1:1 instruction programs.

• Schools must maintain inventory lists of all devices issued and adopt responsible use policies that include written agreements, fines for intentional loss/damage, and acknowledgment that the school retains ownership until devices are sold, auctioned, or traded in.

• Amends Section 7-7-211 to clarify the State Auditor's demand authority does not apply to devices covered by the exemption, preventing penalties against schools for missing student-issued devices.

• Brings forward Sections 37-68-1 through 37-68-15 establishing the "Equity in Distance Learning Act," which provides grant funding to schools for purchasing devices, connectivity, software, professional development, and health/safety equipment.

• Takes effect July 1, 2023.
