Increases maximum jail sentence for first DUI offense from 48 hours to 6 months, with required completion of alcohol safety education program within 9 months (previously 6 months)

Increases maximum imprisonment for second DUI offense within 5 years from 6 months to 9 months, with minimum 5-day jail sentence and 10-to-6-month community service requirement (minimum penalties cannot be suspended or reduced)

Maintains existing penalties for third and subsequent DUI offenses (third offense: 1-5 years felony; fourth or subsequent: 2-10 years felony)

Applies to violations of Section 63-11-30 involving operation of vehicle while under influence of alcohol, controlled substances, or other impairing substances at specified blood alcohol concentration levels

Takes effect July 1, 2023
