First-time simple possession of controlled substances (excluding small amounts of marijuana/synthetic cannabinoids) becomes a misdemeanor punishable by up to 6 months imprisonment and/or $100 fine; second offense carries up to 1 year and/or $200 fine

Current felony-level penalties for simple possession would only apply starting with the third offense, with enhanced penalties under Section 41-29-147 not applying until a fourth or subsequent conviction

Possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids remains subject to existing fine-only penalties ($100-$250) for first offense, with escalating penalties for repeat offenses within two years

Amends Section 41-29-147 to require a fourth or subsequent offense (rather than second) before doubling of authorized prison terms and fines applies

Takes effect July 1, 2023
