Amends Section 63-11-30 of Mississippi Code to allow nonadjudication of a first DUI offense for commercial driver's license (CDL) holders if they were not operating a commercial vehicle at the time of the offense.

Previously, CDL holders were ineligible for nonadjudication of first DUI offenses regardless of what vehicle they were driving; this bill removes that blanket ineligibility.

The bill also clarifies expunction eligibility in Section 63-11-30(13) to allow first-time DUI convictions to be expunged if the person was not driving a vehicle requiring a CDL at the time of offense.

Makes corresponding language changes to the nonadjudication section (14) to align eligibility requirements with the new CDL holder provisions.

Takes effect July 1, 2023.
