SB 2375 Summary

• Brings forward sections 75-24-151 through 75-24-175 of the Mississippi Rental-Purchase Agreement Act, which regulates rental-purchase agreements for personal property with initial terms of four months or less that allow consumers to acquire ownership.

• Brings forward sections 89-8-1 through 89-8-45 of the Residential Landlord and Tenant Act, which governs rental agreements for dwelling units entered after July 1, 1991, and establishes rights and obligations for landlords and tenants.

• Establishes disclosure requirements for rental-purchase agreements including payment terms, cash price, property description, early purchase options, and maintenance responsibilities.

• Sets eviction procedures requiring landlords to file sworn affidavits, provide notice of breach, grant tenants seven days to vacate after judgment (except in emergency cases), and allow tenants to pay rent and avoid eviction before the court-ordered move-out date.

• Effective July 1, 2023.
