Requires the Division of Medicaid to establish fixed liquidated damages amounts to be paid by persons or entities who submit proposals or qualifications and challenge the division's negative decision on a request for proposal.

Requires challenged parties to pay all costs, premiums for bonds, expenses, and fees in any litigation where the Division of Medicaid prevails.

Establishes that liquidated damages clauses shall be valid, enforceable, and not regarded as penalties in Mississippi courts of law or equity.

Brings forward Section 31-7-417, Mississippi Code of 1972, which establishes procedures for proposal and qualification opening, registration, and confidentiality of offerer identities until evaluation is complete.

Takes effect July 1, 2023 (note: contains conflicting language stating it shall be repealed June 30, 2023).
