Changes the mental state requirement for shoplifting from "willfully and unlawfully" to "purposely, knowingly or recklessly" throughout the statute.

Makes a second shoplifting conviction within five years a felony (instead of misdemeanor) when the merchant's stated price of merchandise from both crimes aggregated exceeds $1,000.00, punishable by up to $1,000 fine or up to two years imprisonment or both.

Keeps second shoplifting convictions within five years as misdemeanors when aggregated merchandise value is $1,000.00 or less, with the same penalties as first offenses.

Increases the maximum fine for third or subsequent shoplifting convictions from $1,000.00 to $2,000.00 when merchandise value is between $500.00 and $1,000.00.

Takes effect July 1, 2023.
