Establishes legislative findings that biological differences between sexes exist and warrant creation of separate social, educational, athletic, and other spaces for safety and success.

States that policies and laws distinguishing between sexes are subject to intermediate constitutional scrutiny, allowing distinctions substantially related to important governmental objectives.

Identifies legitimate reasons to distinguish between sexes in athletics, prisons, detention facilities, domestic violence shelters, rape crisis centers, locker rooms, and restrooms where biology, safety, or privacy are implicated.

Requires public schools, school districts, and federal/state/local agencies collecting vital statistics for anti-discrimination or data purposes to identify individuals as either male or female at birth; effective July 1, 2023.
