Increases criminal penalties for possession of fentanyl and fentanyl-related substances (including fentanyl analogs) by amending Section 41-29-139 of the Mississippi Code.

For fentanyl possession of less than 0.1 gram or 2 dosage units: increases penalty from 1 year maximum imprisonment/$1,000 fine to 2 years maximum imprisonment/$2,000 fine.

For fentanyl possession of 0.1 gram or more but less than 2 grams or 2-10 dosage units: increases penalty from 3 years maximum imprisonment/$50,000 fine to 6 years maximum imprisonment/$100,000 fine.

For fentanyl possession of 2-10 grams or 10-20 dosage units: increases penalty from 8 years maximum imprisonment/$250,000 fine to 16 years maximum imprisonment/$500,000 fine.

For fentanyl possession of 10-30 grams or 20-40 dosage units: establishes penalty of 6-40 years imprisonment and up to $1,000,000 fine; takes effect July 1, 2024.
