MS HB1090

Amends Mississippi Code Section 41-29-105 to revise the definition of "paraphernalia" under the Uniform Controlled Substances Law.

Excludes from the paraphernalia definition any materials used or intended for use in testing for the presence of fentanyl or fentanyl analogs in a substance.

Expands the exclusion to include materials used for testing for other emerging or existing drug threats of concern to public health as identified by the State Department of Health.

Effective July 1, 2024.
