Notaries public may charge fees exceeding $5.00 when permitted by state law or rules promulgated by the Secretary of State, replacing the previous strict $5.00 cap.

Qualified nonresidents of Mississippi who are employed or maintain a practice within the state may now apply for and receive a notary public commission.

Nonresident applicants must still meet standard requirements including being at least 18 years old, a U.S. citizen or permanent resident, able to read and write English, and obtaining a $5,000 surety bond.

Notaries public must deposit journal records with the circuit clerk of their county of residence or employment upon resignation, revocation, suspension, death, or adjudication of incompetency.

The act takes effect July 1, 2024.
