HB 1290 Summary - Charity Protection Act

• Creates the "Charity Protection Act" with the purpose of minimizing burdens on charitable organizations and creating a grantmaking environment centered on effectiveness and impact.

• Prohibits state agencies from imposing annual filing or reporting requirements on charitable organizations that are more burdensome than those required under existing charitable solicitation statutes (Sections 79-11-501 through 79-11-529).

• Makes exceptions to the prohibition for state grants and contracts, fraud investigations, and specific enforcement actions against individual nonprofit organizations.

• Amends charitable solicitation statutes to clarify that Secretary of State requirements regarding registration, renewals, financial reporting, and enforcement actions are subject to the new restrictions in Section 4 of this act.

• Sunsets on July 1, 2027, and takes effect July 1, 2024.
