Prohibits the State of Mississippi or any state agency from seeking repayment of Medicaid benefits from Mississippi ABLE accounts, unless required by federal law (42 USC Section 1396p(b)).

Eliminates the previous provision allowing the state to file claims against ABLE accounts upon a beneficiary's death for the total amount of medical assistance provided under Medicaid.

Clarifies that Mississippi ABLE accounts and their proceeds are not considered part of a beneficiary's "estate" for purposes of Medicaid estate recovery claims.

Exempts amounts in Mississippi ABLE accounts from Medicaid lien provisions in Section 43-13-120 and Medicaid recovery provisions in Section 43-13-317, unless required by federal Social Security Act requirements.

Takes effect July 1, 2024.
