First offense simple possession of 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids becomes a civil offense with a fine of $100-$250 instead of a criminal offense.

The civil fine is paid to the municipality or county where the offense occurred, and no criminal record is created for first offenses.

A second conviction within two years becomes a misdemeanor with a $250 fine, up to 60 days in county jail, and mandatory drug education program participation.

A third or subsequent conviction within two years is a misdemeanor punishable by $250-$1,000 fine and up to six months in county jail.

The act takes effect July 1, 2024.
