HB 538 Summary

• Creates a seven-member Mississippi Medicaid Commission with four members appointed by the Governor and three by the Lieutenant Governor, replacing the Division of Medicaid in the Office of the Governor.

• Commission members must have knowledge of Medicaid matters, cannot be Medicaid providers or have financial interests in providers, and serve staggered five-year terms with a two-term limit.

• Transfers all powers, duties, property, employees, and appropriations of the Division of Medicaid to the new Commission effective July 1, 2024.

• Executive Director appointed by the Commission (not Governor) must meet specific qualifications in medical administration or health care policy and serves at the Commission's pleasure.

• Extends the repeal dates of certain Medicaid service provisions and hospital assessment provisions from July 1, 2024 to July 1, 2027.
