House Bill 615 - Mississippi Retail Marijuana Act

• Authorizes adults 21 and older to possess up to one ounce of marijuana and cultivate up to six plants (with three mature plants maximum) for personal use without criminal penalty

• Creates a comprehensive regulatory framework under the State Department of Health as the licensing authority, requiring licensed retail marijuana businesses including stores, cultivation facilities, manufacturers, transporters, and testing facilities

• Establishes a Marijuana Cash Fund to collect and allocate fees from applications ($5,000 per application, split between state and local jurisdictions), licenses, and other regulatory costs

• Prohibits open and public consumption of marijuana except at licensed marijuana hospitality and retail marijuana hospitality and sales businesses, and maintains existing prohibitions on sales to minors, driving under influence, and workplace use

• Allows local jurisdictions to regulate time, place, manner, and number of marijuana establishments and provides a fallback licensing process if the state fails to issue licenses within 90 days of application
