Creates Section 25-11-126 allowing retired Public Employees' Retirement System (PERS) members elected to the legislature to continue receiving retirement allowances while serving, if retirement was at least 90 days before taking office.

Permits current legislators who meet age/service requirements to receive retirement allowances while still serving without withdrawing from office.

Allows recipients to choose between two compensation options: receive 50% of legislative session pay if serving no more than half the normal working days per fiscal year, or receive up to 25% of average compensation with no time limitations.

Specifies that legislators receiving retirement allowances cannot be active PERS members or the Supplemental Legislative Retirement Plan members and receive no additional creditable service during this period.

Effective July 1, 2024.
