HB 861 Summary

• Allows persons receiving a Public Employees' Retirement System (PERS) retirement allowance who are elected to the Legislature after retirement to continue receiving that allowance while serving as a legislator, provided their retirement was at least 90 days before taking office.

• Allows current legislators who meet age and service requirements to begin receiving a PERS retirement allowance while still serving, without needing to resign.

• Provides two compensation options for legislators receiving retirement allowances: receive 50% of legislative session compensation if serving no more than half the normal working days per fiscal year, or receive up to 25% of their average compensation with no time limitations.

• Specifies that legislators receiving retirement allowances under this section shall not be active members of PERS or the Supplemental Legislative Retirement Plan and shall not earn additional creditable service during this period.

• Effective July 1, 2024.
