Requires defendants convicted of aggravated DUI (under Section 63-11-30(5)) to pay court-ordered child support restitution to minor children of the deceased victim until age 21.

Court determines reasonable support amount by considering child's financial needs, surviving parent/guardian resources, child's standard of living, educational needs, custody arrangements, and deceased parent's wage-earning capacity.

Child support payments directed to court clerk as trustee for remittance to surviving parent or guardian within 3 working days of receipt.

Defendants released from incarceration may have up to 1 year to begin payments and establish payment plans for any arrearages; payments continue until fully paid regardless of child's age.

Civil judgments obtained by surviving parent or guardian against the defendant are offset against the child support restitution order upon defendant's motion.
