MS SB2129

Allows retired attorneys to file affidavits of scrivener's error to correct typographical or minor errors in real property documents, provided they were in good standing and licensed when the original document was recorded.

Requires the scrivener's error affidavit to state that the affiant attorney either is currently in good standing and active, or was in good standing when the document was recorded and is now retired from practice.

Maintains existing requirements that only attorneys licensed to practice law in Mississippi who prepared documents in the chain of title may file scrivener's error affidavits; any filed by non-attorneys are void.

Effective July 1, 2024.
