Adds a new enhanced penalty of 5 years imprisonment (consecutive, non-reducible) for using or displaying a firearm during gang-related activity, as defined in Section 97-44-3(d).

Changes gang activity penalties under Section 97-44-19 from "not less than one year nor more than one-half the maximum term" to "an additional term equal to that imposed for the underlying offense," with sentences running consecutively to underlying offense punishments.

Applies the equal-term penalty enhancement to all four categories of gang-related conduct: directing/participating in gang activity, committing felonies for gang benefit, committing non-felony offenses for gang benefit, and selling/buying goods or services for gang purposes.

Preserves judicial discretion to suspend enhanced punishments in unusual cases where justice requires, allowing alternative community service or adolescent offender program placement if circumstances are documented on the record.

Takes effect July 1, 2024.
