Criminalizes intentional dissemination or publication of intimate images or audio created or altered through digitization (including AI, deepfakes, or computer-generated media) with intent to cause emotional, financial, or physical harm when the depicted person did not consent.

Defines "digitization" as altering images or audio in a realistic manner using images/audio of other persons or computer-generated means, including software, machine learning, and artificial intelligence.

Establishes felony penalties for offenders age 21 and over (punished under existing Section 97-29-63 for non-consensual photography), and misdemeanor penalties for offenders under age 21 (up to $2,500 fine or one year imprisonment).

Allows enhanced penalties of up to twice the standard sentence for second or subsequent offenses arising from separate incidents at least 30 days apart.

Exempts reporting of unlawful conduct, lawful law enforcement or medical uses, voluntary public exposure, legitimate public purpose dissemination, and internet service providers acting as neutral platforms.
