Creates a rebuttable presumption that joint custody with equally shared parenting time is in the best interest of the child in all custody matters.

The presumption can be rebutted by a preponderance of the evidence, and courts must document in writing the reasons for deviating from joint custody with equal parenting time.

If joint custody and equal parenting time are not awarded, courts must construct a parenting time schedule that maximizes time each parent has with the child.

Maintains existing protections against awarding custody to parents with a history of perpetrating family violence, which carries its own rebuttable presumption against custody.

Takes effect July 1, 2024.
