Senate Bill 2530 - Peer-to-Peer Car Sharing Program Act

• Creates the Peer-to-Peer Car Sharing Program Act to authorize vehicle owners and drivers to share vehicles for financial consideration through a business platform, explicitly excluding peer-to-peer car sharing from rental car, transportation network company, and motor vehicle rental definitions.

• Requires peer-to-peer car sharing programs to assume liability for shared vehicle owners during the car sharing period for bodily injury, property damage, and uninsured/underinsured motorist losses in amounts not less than Section 63-15-43 minimums, with exceptions for intentional misrepresentation or fraud.

• Mandates peer-to-peer car sharing programs maintain motor vehicle liability insurance covering both owners and drivers during car sharing periods, which can be satisfied by insurance from the owner, driver, program, or any combination thereof, with the program's insurance being primary if owner/driver coverage lapses.

• Requires consumer protection disclosures in car sharing agreements including indemnification rights, insurance coverage limitations, daily rates and fees, emergency contact numbers, and conditions requiring drivers to maintain personal automobile insurance.

• Establishes that peer-to-peer car sharing programs must verify driver's licenses, maintain records of usage for three years, handle safety recall procedures, and exempts programs and vehicle owners from vicarious liability consistent with 49 USC Section 30106; takes effect 270 days after Governor's signature.
