Amends Section 71-3-35 of Mississippi Code to clarify that the two-year statute of limitations for workers' compensation claims begins running from the date of the accident or incident giving rise to the injury or death.

Adds a presumption that a defendant is entitled to dismissal if they file a motion showing the accident or incident occurred at least two years before the application for benefits was filed with the commission and no compensation was paid (except medical treatment or burial expenses).

Preserves existing exceptions for mentally incompetent persons and minors without guardians, whose filing deadline begins when a guardian is appointed or when a minor reaches age of majority.

Preserves existing exception that the filing deadline begins from the date a civil lawsuit is terminated if compensation recovery was initially denied based on employee-employer status.

Effective July 1, 2024.
