SB 2623 Summary

• Simple possession of 30 grams or less of marijuana becomes a civil infraction with a fine of $100, rather than a criminal offense.

• First violation is a civil fine of $100; second violation within 2 years is a misdemeanor with a $250 fine, up to 60 days jail, and mandatory drug education program; third or subsequent violation within 2 years is a misdemeanor with $250-$1,000 fine and up to 6 months jail.

• Possession of more than 1 gram but not more than 30 grams of marijuana in a motor vehicle (in areas normally occupied by driver/passengers) becomes a civil infraction with a $100 fine.

• Municipal courts are granted jurisdiction to hear civil infractions and impose civil penalties under this law.

• The act takes effect July 1, 2024.
